Luka Doncic ends fight with his mother over trademark rights to his name: All you need to know
NBA and Dallas Mavericks superstar Luka Doncic ended his long-standing legal battle that started in September this year with his mother, Mirjam Poterbin, over trademark rights to his name. Doncic had filed to erase the trademark "Luka Doncic 7," owned by his mom.
He wanted to pursue a new trademark with "77," replacing the "7." However, an examiner considered Doncic's application to file his trademark could cause consumer confusion due to the mark his mom has owned since 2018.
The Mavericks superstar intended to release his line of goods and services with the "77" trademark in the US. However, the other trademark owned by his mother, highlighted by No. 7, was still active.
Doncic filed a petition to cancel the mark owned by his mother. Doncic claimed that his case to cancel the registration of the "7" mark is based on the fact that, "upon information and belief," his mother didn't use the trademark in the US. According to him, she didn't show the intent to resume the use of the logo. Doncic also cited that he has no association with the trademark anymore.
Luka Doncic's mother turned this case into a legal battle
Mirjam Poterbin retaliated against her son's petition to cancel the "Luka Doncic 7" trademark by filing a motion to dismiss the case. She argued that the Mavericks superstar lacked valid ground to cancel the mark.
Doncic had not backed up his allegations over the lack of activity with the trademark in the US. The 3x NBA All-Star didn't provide factual support or demonstrate a reasonable inquiry into the non-usage of the logo.
Poterbin had the right to make business decisions for her son when they filed the "Luka Doncic 7" trademark. Doncic had given written consent over the logo's usage on goods and services. Poterbin claimed that her son had admitted to this and that she provided long-term assistance regarding business affairs related to the line of goods and services associated with the "7" mark.
However, Poterbin didn't contradict Doncic's allegations with factual indications or evidence that the logo is in use commercially in the country or regarding her intentions to resume business affairs with the logo.
Both sides firmly stood their ground with valid reasoning to an extent, making it a complicated legal battle. However, according to a report by Law360, it's all put to bed now with Doncic ending this fight with his mom.
