Tiger Woods’ legal team release latest update from a court filing this morning
Tiger Woods' lawyers have unloaded in response to the sexual assault allegations and lawsuit levied towards their client, the star golfer.
Woods was sued by his ex-girlfriend Erica Herman for sexual assault, which nullifies the NDA she initially signed when they began dating.
The Speak Out Act allows her to violate the NDA if there was assault, which she is alleging. Naturally, Tiger Woods and his team don't want this to happen.
The filing from the lawyers says this:
"Here, Ms. Herman's claims relate to a lease dispute under Florida's landlord-tenant act, not a sexual harassment or sexual assault dispute. Ms. Herman is not a victim of sexual assault or abuse sought to be protected by Congress when enacting the statute."
"Rather, Ms. Herman is a jilted ex-girlfriend who wants to publicly litigate specious claims in court, rather than honor her commitment to arbitrate disputes in a confidential arbitration proceeding."
The language used in the filing is anything but kind. The lawyers got straight to the point and responded with criticism to what they and Woods believe is a nonsensical lawsuit.
What happened with Erica Herman and Tiger Woods?
The suit was filed last week and has already seen a frenzy of action. The lawyers for Tiger Woods initially motioned to intervene, disputing part of Herman's suit (via ESPN):
"During their relationship, Mr. Woods invited Ms. Herman to live with him as his guest in the Residence. Mr. Woods never negotiated an oral tenancy agreement with Ms. Herman. Nor was there ever a written tenancy agreement between Mr. Woods or the Trust, on the one hand, and Ms. Herman, on the other hand."
"Mr. Woods never transferred to Ms. Herman any ownership interest in or rights of possession to the Residence."
This will be an explosive case as a lot hangs in the balance. The public image of Woods, which has been carefully reformed since his infidelity and car crash, is in danger once again.
Tiger Woods believes Herman is not a sexual abuse victim, but rather just a jilted former lover. The golfer claims that the initial lawsuit filed stated that this case, which was part of an oral tenancy agreement that the lawyers disputed, did not involve sexual assault as per Herman's own filing.
The couple recently broke up and Woods forced her to move out. He provided temporary housing for her and funds to get her own place to live, which is a big part of the battle right now.
Herman's lawsuit alleges that the NDA is being wrongfully enforced upon her and that she was a victim of sexual abuse at Tiger Woods' hands. That is tricky to prove in court, but Herman has also gotten the allegations out there regardless of how the case turns out.
