Johnny Gaudreau’s family faced the driver accused of killing Johnny and his brother Matthew in court on Tuesday. The Gaudreau brothers were struck and killed by Higgins’ truck on Aug. 29 while cycling near their family home in New Jersey.

Prosecutors accuse Higgins of being under the influence, with reports stating he had consumed around six beers prior to the incident. During the hearing, the judge extended the timeline for prosecutors to seek an indictment.

Higgins, who has a history of road rage, was allegedly found to have a blood-alcohol level of 0.087, above New Jersey’s legal limit of 0.08. He now faces multiple charges, including two counts of death by auto, reckless driving, and open container violations. If convicted, he could receive up to 20 years in prison.
